(1)-(3) As detailed in response to previous questions from the Member, the Premier acting under delegation pursuant to the Environmental Protection Act, was obliged to consider only the environmental factors relevant to the proposal in determining the appeals relating to the proposal. In his capacity as the delegate of the Minister for the Environment, the Premier determined that the proposal was environmentally unacceptable based on a number of factors. On this basis, there was no need for such advice to be sought from the Department of Industry and Resources.
