Electronic monitoring—Conditions
breach
105. Hon Peter Collier to the minister representing the Minister for Police:
(1)
Will the minister confirm whether there are any circumstances under which
police officers are required to obtain a warrant before arresting a person for
breaching conditions associated with an electronic monitoring device?
(2)
If yes to (1), what are those circumstances and under what legislation or
operational directive do they arise?

I thank the
honourable member for some notice of the question.
(1)–(2) The Western Australia Police Force does not require an arrest
warrant for a breach of electronic monitoring for family and domestic violence
cases. The Western Australia Police Force, in consultation with the Department
of Justice, will continue to use the most appropriate mechanism and approach
for arresting anyone who has breached the conditions of electronic monitoring.
