I refer to the Commissioner for Public Sector Standards report dated April 16 2003 concerning the Anti Corruption Commission and the investigation/monitoring of compliance/reporting with the Public Sector Code of Ethics for all government agencies -
(1) Can the Minister explain why the Commissioner for Public Sector Standards did not conduct specific investigations in terms of monitoring and reporting compliance with the Public Sector Code of Ethics, but rather conducted a broader review on the key issues raised?
(2) If no to (1), why not?
(3) Is it correct that the current Commissioner for Public Sector Standards does not take the approach of conducting investigations into monitoring for compliance, specific breaches of the Public Sector Code of Ethics when complaints are made by members of the public, whereas the previous Commissioner did this?
(4) If yes to (3), can the Minister explain why this occurs?
(5) If no to (3), can the Minister clearly explain what does occur?
(6) Can the Minister state specifically who investigates and reports on specific allegations not related to human resource management practices made by members of the public concerning breaches of the Public Sector Code of Ethics for all government agencies that the code applies to?
(7) If no to (6), why not?

(1) The Member’s question concerns matters that are within the exclusive operational competence of the Commissioner for Public Sector Standards, therefore I cannot provide an answer. (2) - (5) See (1) above (6) In accordance with the Public Sector Management Act, the general principles of official conduct are to be observed by all public sector bodies and employees, this includes complying with the Public Sector Code of Ethics. Alleged non-compliance with the Code of Ethics may be investigated by employing authorities or the Office of the Public Sector Standards Commissioner. (7) Not applicable.
