Given that in a previous answer the Minister has confirmed that the Moore River Estuary is not excluded by the ultimate sentence in Clause 3 of SPP 2.6 which reads ‘This policy does not apply to estuaries that are predominantly riverine in character’ -
(1) Can the Minister confirm that minimum setback distances from the river foreshore are to comply with SPP 2.6, that is, a minimum of 100 metres from the first line of stable vegetation?
(2) If yes to (1), does that mean the development setback will be 100 metres beyond the southern edge of the Moore River Quindalup sand dunes known locally as the ‘Desert’?
(3) If yes to (2), will the Minister ensure that the proposal for urban development is altered to comply with SPP 2.6, or will this development be excused from compliance with SPP 2.6?
(4) If the answer is no to (2) or (3), does the Minister still believe that SPP 2.6 protects the Moore River Estuary?

(1) An appropriate width for the riverine foreshore reserve will be determined using the principles set out in Clause 5.2 of SPP 2.6. These include consideration of landform stability; ecological values, water quality; recreation and public access; landscape and visual amenity; indigenous and cultural heritage and land capability. (2) In regard to coastal setbacks, SPP 2.6 states that as a general guide a total setback in the order of 100 metres from the “horizontal setback datum” would be expected on a sandy coast. However, the proposed development needs to be individually assessed and the setback would be determined based on the site specific circumstances. (3) Any development south of the Moore River at Guilderton will be required to take into account the requirements of SPP 2.6 (4) The Gingin Coast Structure Plan and the Shire of Gingin Town Planning Scheme are currently under review and the revised instruments together with SPP 2.6 will adequately protect the Moore River Estuary.
