DUNE SYSTEM
56. Hon ROBIN CHAPPLE to the
minister representing the Minister for Environment:
I refer to question on notice 363 and questions without
notice 864, 960 and 1029 regarding the removal of part of a dune system in
Esperance.
(1) Will the
minister confirm that no further unauthorised clearing of native vegetation or
the dune system will occur in the future?
(2) If no to (1), why not?
(3) If yes to
(1), will the department advise all relevant bodies of the need to refer such
activities to the department?
(4) Why are dune
systems exempt from the requirement for a clearing permit under schedule 6,
clause 9 of the Environmental Protection Act 1986?

The Department of Environment Regulation is unable to give an assurance that
unauthorised clearing by any individual will not occur in the future.
(3) Not applicable.
(4) Native
vegetation clearing is regulated under the Environmental Protection Act 1986
and Environmental Protection (Clearing of Native Vegetation) Regulations 2004.
No differentiation is made between dune system native vegetation and all other
forms of native vegetation in the definition of the term ''native
vegetation'' in the act.
