(1) What measures have been taken by the Minister’s department to prepare for the imminent ratification of the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT) by the Australian Government and to ensure compliance by Western Australia Police (WAPOL)?
(2) Is consideration being given to granting the Inspector of Custodial Services jurisdiction over police lock-ups for the purpose of compliance with OPCAT or more generally?
(3) Has the Minister received advice as to the implications, both administrative and financial, of OPCAT for the current operations of WAPOL; and

(1) Western Australia Police is aware that the Commonwealth Government is currently giving consideration to the ratification of the Optional Protocol to the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment (OPCAT). If ratified, practical implementation of this Protocol will depend on the model of National Preventative Mechanism (NPM)s adopted. This model will be determined via a consultation process between the Commonwealth Government and the States and Territories. This consultation process has yet to occur.
(2) Not applicable.
(3 - 3(i)) Western Australia Police has not, to date, provided any information to the Minister for Police; Emergency Services; Road Safety regarding implications of the ratification of OPCAT.
