I thank the member for some notice of this question. (1) The Fortescue Metals Group submitted a letter and a port facilities information document to the minister on 17 March 2006. Under clause 8(1) of the Railway and Port (The Pilbara Infrastructure Pty Ltd) Agreement Act, the company is required to consult the minister and seek the minister’s agreement on the areas within the port of Port Hedland to be the subject of leases and licences to the company and the nature and characteristics of the facilities to be constructed there. (2) The company is still negotiating with the Port Hedland Port Authority with regard to the layout of its proposed facilities in the port and the lease areas, so it is premature for the minister to indicate agreement. It is understood that this morning the company and the port authority reached agreement on the outstanding issues. The company will be resubmitting its proposals under clause 8(1) of the agreement.
