With regard to Register of the National Estate, Number
010068, File Number
5/08/202/0007, the Spoil Bank, Port Hedland, given that the area is identified as being used as breeding area by the Australian pelican, other seabirds and turtles, given that the area (VCL) is under the Port Hedland Port Authority control -
(1) Why is the Port Hedland Port Authority allowing unbridled vehicle access over this area?
(2) Does the Minister consider 4WD vehicle access to the Spoil Bank pose any problem to the structural integrity of the Spoil Bank or potential coastal environmental harm?

· Review of the Register of the National Estate does not record any listing for the Spoil Bank in Port Hedland. The Register Number 010068 as quoted in the question relates to islands extending from Dixon Island some 230 kilometres west of Port Hedland to Bedout Island some 95 kilometres east. The Spoil Bank is not an island. · The Heritage website states that listing in the Register of the National Estate does not directly affect the way in which private, State or local government land is managed. · The Spoil Bank is an area where dredged material was placed during the channel development programs. It is possible that this area may again be used for the placement of dredge material or the material excavated and used for other projects within Port Hedland. It is identified as 'foul ground'. · The local Town Council as part of the Port Hedland Area Planning Study identified the Spoil Bank as a recreational area. The Spoil bank is seen as a significant recreational facility by the community. · The Port Authority is not aware of any significant breeding activity by seabirds and turtles on the Spoil Bank.
