I refer to the Keelty Perth Hills fires report in which it is recommended that it should be a mandatory notation on title deeds for properties in declared bushfire prone areas and ask: (a) how has this recommendation been advanced; (b) what is the current status of the recommendation; and (c) if the recommendation is not being implemented what are the reasons for rejecting it?

(a) During 2011, Landgate explored options to address this recommendation so that the Bushfire Prone Area (BPA) information could be made available without the need for legislative changes. It was determined that Landgate's "Interest Enquiry" system was the preferred mechanism to achieve this.
Landgate presented the Interest Enquiry solution to the Interim Property Industry Advisory Group (IPIAG) in late 2011. This group included senior representatives from the Real Estate Institute of Western Australia (REIWA), Australian Institute of Conveyancers WA Division (AICWA), Australian Property Institute, Strata Community Australia, Australian Institute of Business Brokers and Department of Commerce. IPIAG supported the use of Interest Enquiry for the implementation of Recommendation 40 of the Keelty Report.
Landgate has also advised relevant government agencies of this agreed approach. Landgate has been assisting the Office of Bushfire Risk Management, the Department of Fire and Emergency Services (DFES), the Western Australian Planning Commission (WAPC) and other agencies with the BPA mapping process.
Completion of recommendation 40 relies on recommendation 3, which proposes the transfer of responsibility for declaring bushfire prone areas from local government to the Western Australian Planning Commission (WAPC).
(b) Once BPA information is provided to Landgate, it will ensure that it is included as an interest in Interest Enquiry and made publicly available via a Property Interest  Report on relevant properties. It is intended to also make BPA information available on Locate - the new website that brings together WA's important location information.  Landgate continues to work with WAPC and other agencies to help with the BPA mapping process.
