I refer to Question without Notice No. 70 asked on August 21 2002 in respect of the land comprised in Certificate of Title Volume 1138 Folio 74, and ask -
(1) If the Minister has formed an opinion on the issue of whether the land should be offered to the former owners in accordance with S37(6)(c) of the
Metropolitan Region Town Planning Scheme Act

However I can advise the Member that the WAPC and Main Roads Western Australia (MRWA) propose that the remaining section of land at Certificate of Title 1138 Folio 74 be amalgamated with the surplus portions of three adjoining lots to the north also owned by the WAPC and MRWA. Amalgamation is necessary as the properties to the north are denied access to Loftus Street due to a difference in levels and policy to restrict the number of access points to roads such as Loftus Street. The amalgamated site would have access to Kingston St. A joint disposal of the amalgamated site by the WAPC and MRWA is contemplated during the 2004/05 financial year subject to the Minister exercising her statutory duty when requested to do so by the WAPC.
