Referring to the Environmental Monitoring and Management Plan (EMMP) associated with the Port Geographe project in Busselton particularly to the water quality monitoring as specified in section 3 of the EMMP.
The EMMP requires that sampling be conducted on a semi-annual basis (January and July) during the first 4 years after construction and quarterly during the fifth year -
(1) Have these testing requirements been adhered to in accordance with the EMMP over each of the first 5 years as per sections -
(a) 3.4.2 Water Quality;
(b) 3.4.3 Metals in Biotas; and
(c) 3.4.4 Sediment Quality?
(2) Please provide the test results from each of the above sections throughout the first five years.
(3) Please provide details of the testing regime currently in place.

Results for the first five years cannot be provided since the proponent failed to routinely conduct monitoring prior to 2005. This was the basis of the non-compliance warning issued to the proponent in 2005. (3) The current testing regime is described in Attachment 4 [see tabled paper no].
