I refer to the Port Hedland Port Authority copper concentrate storage shed. (1) Is the minister aware of any issue that would legally prevent the Environmental Protection Authority from assessing any aspect of this proposal on the grounds of - (a) commercial-in-confidence; (b) land tenure; (c) status of the port authority; or (d) any other grounds? (2) Will the minister outline what grounds, if any, would be sufficient to exempt any given proposed project from assessment by the Environmental Protection Authority? Hon TOM STEPHENS

I thank the member for some notice of this question. The Minister for the Environment has provided the following response - (1)-(2) Providing the information in the time required is not possible. I am advised that the Environmental Protection Authority is reviewing the legal position on this matter. Accordingly, I request that the member place the question on notice.
