Under the
Education Act 1999
, the responsibility is placed on schools to intervene. The penalties for prosecution have increased to a maximum of a $1000,.  The
Act
details specific procedures which schools and district offices must follow
Before prosecution can be considered three steps must be taken:
an Attendance Panel convened
a 'Certificate of Non-Compliance' issued if there is no improvement
advice sought from the State Solicitor's Office.
In 2006 15 Attendance Panels were convened, in 2007 there were 16 and there have been 4 in 2008.
To date, no parents have been prosecuted under the
Education Act 1999
