(1) Given that the BCITF is refusing to provide any funding for the BCITC for 2000-2001 despite the BCITC s compliance with all requests in the preparation of the funding submissions, will the Minister for Employment and Training now issue a direction under section 9 of the Building and Construction Industry Training Fund and Levy Collection Act 1990 to instruct the board to provide funding to the BCITC for its programmes and project submissions? (1)-(2)I am informed that the Board requested that the BCITC submit its funding application against a range of criteria detailed within a funding submission guideline document provided to the Council, and that the submission has been fully evaluated against these criteria. The power of the Minister to direct the Board under Section 9 of the Act relates to the Board's functions and powers. The Board's functions and powers essentially involve the collection of the levy, the funding of Operational Plans which amount to allocation of resources for training and funding of other activities necessary or convenient to those matters. Any expenditure by the Board from the Fund must be within section 18 of the Act, that is expenditure authorised under an approved Operational Plan or which is lawfully incurred by the Board in the exercise of its functions. In the present case, the Operational Plan does not provide for any allocation of money from the Fund for the BCITC. Section 9 of the Act empowers the Minister to give direction to the Board to in relation the Board's functions and powers. A direction to fund the BCITC outside the Operational Plan would not be permissible unless it related to expenditure incurred in the exercise of the Board's functions.
