School Education Act 1999
, are incorporated associations under the
Associations Incorporation Act 1987
.
Incorporation of a Parents and Citizens' Association means that it becomes a legal entity in its own right, separate from the Department of Education.
As a separate legal entity, it is a matter for the Parents and Citizens' Association to respond to legal proceedings against it. If the principal of the school believes the Department of Education can be of assistance to the Parents and Citizens' Association in the circumstances, the principal can raise the matter with the school's line management and the matter will be considered by the Department on a case by case basis.
