I refer to tenders for microbiological control at Fiona Stanley Hospital, and I ask: (a) is the Minister for Health aware that, prior to tenders closing, two Western Australian companies requested details of this tender from Serco, did not receive this information prior to tenders closing, and when they followed the issue up were advised tenders had now closed and missed the opportunity to bid for these services due to this poor tender process; (b) is the Government using Serco to bypass its local content commitments; (c) will the Minister investigate why the tender process has been mishandled and request Serco consider re-advertising for this service, or enable late submissions given they did not distribute the tender information details as soon as requested; and (d) has the tender for this service now been determined and, if so, is the successful applicant a Western Australian company, or a multi-national company?

Answer as at 2 February 2015 -
(a) I am advised that of the companies to which you refer, one company applied for tender documentation on 31 October 2014 at 10.29am, three and a half hours prior to the tender closing.  Due to other activities, the timing and a potential technical issue the company did not receive the information required before the deadline of 2.00pm. The other company applied for tender documentation only minutes prior to the tender closing and therefore was not registered on the system.
Following up from this issue raised by a potential respondent, given the overall background and time still available before these services were required, the Serco procurement team re-opened the process on 10 November 2014 and all interested parties, including those who had already submitted their documentation, were notified. The potential respondent was satisfied with this approach.
(b) No. Subject to State review the Facilities Manager must comply with the procurement provisions of the Facilities Management Services Contract, namely that the process provides fair competition, is transparent in respect of process, cost, scope and outcome, and results in a reasonable level of competition within the market.
(c) Not applicable.
(d) The tender process has not yet been concluded.
