I refer to the Cristal Global, formally Millenium Inorganic Chemicals, titanium dioxide residue waste site at Dalyellup, and ask:
(a) what classification has the Department of Environment and Conservation given to the waste dumped at the site;
(b) did the dumping of waste cease on 13 April 2013 as per the contract;
(c) what is the proposed rehabilitation plan for the site;
(d) how long will this rehabilitation process take; and
(e) in determining the future use of the site, will the Department of Environment and Conservation, ensure that a non-permeable membrane be placed over the pond area, prior to covering with sand?

(a) The Department of Environment and Conservation (DEC) has classified
the Cristal Global titanium dioxide residue disposal facility at Dalyellup as possibly contaminated - investigation required under the Contaminated Sites Act 2003 (CS Act).
(b) Waste ceased to be discharged at the Cristal Global Dalyellup
facility on 3 March 2013, the day on which the licence issued to Cristal Global
for the premises under the Environmental Protection Act 1986 expired.
(c)-(d) A proposed rehabilitation plan has been submitted to the Office
of the Environmental Protection Authority. As part of the process of
considering this plan, appropriate timelines for rehabilitation will be
determined.
(e) DEC will ensure that the site has been sufficiently rehabilitated
to contemporary human health and environmental protection standards and is
suitable for the proposed future use before it is re-classified remediated
for restricted use under the CS Act. There may be a number of
remedial options that will achieve this outcome. DEC will ensure the outcome
has been achieved, as demonstrated through validation monitoring after
remediation, but does not specify the remediation method.
