I refer to the answers to my questions on notice Nos 3887 and 3888, and ask-
(1) How does the Department become aware of alleged breaches of license conditions?
(2) Will the Minister please describe any and all internal processes used for determining the appropriate level of compliance and/or enforcement action to be undertaken for non-compliance and table any and all relevant documents?
(3) Will the Minister please table the draft compliance and enforcement policy that is now being implemented?
(4) When does the Minister anticipate that the Department’s licensing systems will be capable of identifying water licences with a requirement to report meter readings for a given 12 month period?
(5) How many of the 661 licensed and metered users in the Gnangara Groundwater Management Area that are required to report their meter readings to the Department of Water did so in 2010?
(6) What does the Minister regard as an appropriate initial compliance and enforcement action for -
(a) failure to report a meter reading;
(b) over-extraction at less than 10 percent of licensed extraction;
(c) over-extraction at between 10 and 25 percent of licensed extraction;
(d) over-extraction at between 25 and 50 percent of licensed extraction; and
(e) over-extraction at greater than 50 percent of licensed extraction?
(7) How many licensed and metered users on the Gnangara Mound extracted a volume of water more than five percent greater than their licensed amount in each of the following years -
(a) 2006-07;
(b) 2007-08;
(c) 2008-09; and
(d) 2009-10?

The Minister for Water provides the following response:
(1) The Department of Water (DoW) becomes aware of alleged breaches of licence conditions through:
· information provided by the licensee;
· compliance surveys undertaken by the DoW;
· complaints by other water users or the general public; and
· the DoW's licence renewal process.
(2) The DoW's Compliance and Enforcement Incident Assessment and Response Tool.
(3) No. The document is in draft form and will be released when it is finalised.
(4) The DoW System can provide a report of current water licences with a requirement to report the meter readings, but not retrospective data.
