I refer to the ABC Four Corners program on 20 March 2000 concerning the involvement of Kingstream Resources in initiating native title claims, and the involvement of a Neil Phillips who confirmed he had received money from a Kingstream Resources executive. (1) Is this Neil Phillips the same Neil Phillips who was released from prison early on an order of the Executive Council? (2) If yes, what were the reasons for his early release? (3) On whose recommendation was the early release order made? (4) How many other people have been given early release under this same mechanism in the past 12 months? Hon PETER FOSS

(1) A person by the name of Neil Phillips was released from prison on 29 October 1998, pursuant to section 141 of the Sentencing Act 1995. On the information available, it appears that it is the same person. (2) Mr Phillips was released early due to a serious medical complaint that was potentially life threatening. Representations were made by Aboriginal people, and the victim of the crime agreed to the release. (3) The release was recommended to the Governor on the advice of the Director of Health Services, Dr Gerard Hodgkinson. (4) During the past 12 months a small number of prisoners have been released early due to serious medical conditions. To answer this question would require a manual search of all prisoner records. I table the director general's rules relating to early release. [See paper No 396.]
