208. Hon TJORN SIBMA to the minister representing the
Treasurer:
I refer to concerns expressed by the
president of the Law Society of Western Australia, Paula Wilkinson, regarding
the Insurance Legislation Amendment (Motor Vehicle Claims Harvesting) Bill 2023
in her letter to the minister of 1 March 2024.
(1) Why was the
Law Society not provided with a draft copy of the bill before it was
introduced, despite this being a promise made in writing by ex-Premier Hon Mark
McGowan in February last year?
(2) Noting that
the Law Society considers the bill to be ''unworkable'' and that
its proposed changes ''will undermine the rule of law'', will the
Treasurer now rescind the bill?

been provided to me by the Treasurer.
(1)–(2) Feedback
received during stakeholder consultation, including from the various
representative bodies of the legal profession, assisted in shaping the proposed
legislative reforms. The intent of the bill is to stop people's
personal details being traded for money and ensure that Western Australians
injured in motor vehicle accidents are able to have their claims resolved in a more
timely manner and without unnecessary transaction costs.
