Under the provisions of section 39B of the
Environmental Protection Act 1986
the proponent of a proposal referred to the Authority under section 38 may request that it be declared a "derived proposal" and will not be assessed again, and I ask –
(1) How many "derived proposal" assessments have been made the Minister’s departments since 2002?
(2) Can the Minister supply a full list of names for all "derived proposal" assessments conducted under the provisions of the EPA Act 1986 since 2002?

A referred proposal can only be declared to be a "derived proposal" under Section 39B(3) of the Environmental Protection Act 1986 if the referred proposal was identified in a "strategic proposal" that has been assessed by the Environmental Protection Authority and approved by the Minister for the Environment. Because the category of "strategic proposal" results from relatively recent amendments to the Environmental Protection Act 1986 , there have not been any strategic proposals that have been assessed and approved. Hence no "derived proposals" have yet been declared. (2) Not relevant.
