In relation to Contract of Sale Number 2770, between the Forest Products Commission (FPC) and Gunns Limited for the annual sale of, -
(a) 90 780 tonnes of first and second grade jarrah sawlogs;
(b) 37 200 tonnes of third grade jarrah sawlogs up to quantity specified;
(c) 5 000 tonnes of marri sawlogs up to quantity specified, -
I ask, -
(1) On what basis can the FPC not sell and Gunns Limited not buy the contracted amounts of sawlogs?
(2) For each of (a), (b) and (c), what base and gross stumpage was Gunns Limited paying?
(3) Has the FPC, -
(a) assigned these contracts or parts thereof; or
(b) entered into new contracts for the sale of any of Gunns’ contracted amounts of sawlogs?
(4) If yes to (3), -
(a) to which buyers;
(b) in what amounts and for what species;
(c) for what base and gross stumpage(s) per tonne;
(d) are the stumpages to be paid by the new buyer(s) the same as the stumpages paid by Gunns Limited; and
(e) if no to (3) (d), why not?
(5) If the total amount of sawlogs the FPC is contracted to sell to Gunns Limited is not assigned to another buyer, -
(a) will the FPC continue felling logs for which it does not have a buyer; or
(b) will it reduce the amount of logs that are cut?
