Can the Minister please provide the agreement documents of the following dates between One Movement and Tourism Western Australia and referred to in the report by the Public Sector Commissioner on 18 January 2010 regarding the conflict of interest at Tourism Western Australia with the One Movement funding:
(a) January 2009, regarding international artists;
(b) 23 January 2009, regarding the term ‘delegate’;
(c) 3 February 2009, regarding marketing;
(d) 23 February 2009, regarding the State Solicitor’s Office (SSO) ‘sign-off’, including any comments offered by the SSO; and
(e) 9 March 2009, regarding sponsorship agreement?

(a) - (c) No. As outlined in my letter to you dated 22 February 2010, Tourism Western Australia has advised that these documents contain commercial information sensitive to third parties from the public and private sectors. I am advised by Tourism WA that the release of such information would have a significant adverse effect on its business, professional, commercial and financial affairs, as well as those of third parties. Therefore, as a matter of procedural fairness to those third parties, it would be necessary for these documents to be obtained through the Freedom of Information process.
Furthermore, I am advised that Tourism WA is contractually barred from disclosing the Agreement documents you seek.
(d) No, the document is subject to legal professional privilege.
(e) Please refer to answer (a) - (c) above.
