I refer to Town Planning Scheme Amendment No. 29 - proposed realignment of a portion of the Eastern Bypass Road -
(1) Is the Minister aware that complaints have been made to the Minister for Local Government which respect to councillors not declaring certain interests as required by the
Local Government Act
and various Regulations with respect to the above town planning scheme amendment?
(2) If not, will the Minister make herself aware and informed of these complaints?
(3) If yes, can the Minister state of what she is aware?

The Minister's determination of Amendment No.29 is guided by the provisions of the Town Planning and Development Act and Town Planning Regulations which outline the matters she is to have regard to. They do not involve the internal proceedings and operation of a Council, as such a matter is a concern under the Local Government Act. The Minister was aware that the allegations had been correctly referred to the Minister for Local Government; The Minister's approval of the eastern realignment was based on the advantages it has over the other options put forward and on technical advice provided not only from the City but also from Main Roads Western Australia and the Western Australian Planning Commission, all of which supported the eastern realignment; The allegations made against various Councillors and the findings of any subsequent investigation by the Department of Local Government has no bearing on the Minister's decision. (2) N/A. (3) In view of the Minister's position on Question 1 there is no reason for her to discuss the detail of these allegations.
