(1) It's the role of the Department to provide housing for those most in need. This includes people who have no other housing options. The Department seeks to balance providing a home and support for the more disadvantaged members of our community, with the broader community's right to a peaceful and safe neighbourhood. Especially where children are involved, efforts needs to be made to try to provide them with a home before a decision is taken to evict a family from public housing. The Department does not condone anti-social behaviour caused by its tenants. Where that behavior is in breach of their tenancy agreement, the appropriate action will be taken. The Department is bound by the Residential Tenancies Act 1987. The processes prescribed by the Residential Tenancies Act (1987) involve responses to substantiated complaints, which are progressively a Notice of Breach, a Notice of Termination and finally court action to terminate a tenancy. The Department investigates complaints to confirm what has occurred so appropriate action, including eviction, can be taken against a tenant. With regard to anti-social and criminal behaviour, the Department fully supports police efforts to identify and charge the perpetrators.
