In relation to the dams on Lot 12 Bird Road, Oldbury -
(1) Were both of the dams drained of water prior to being backfilled?
(2) If so, when was it done?
(3) Who was responsible for the draining?
(4) Were any DEP or EPA officers on site when this occurred?
(5) If so, who?
(6) If not, why not?

The Minister Replied:
(1) The Department of Environmental Protection (DEP) advises that the dams were not drained as they contained only a small amount of water or were dry prior to being backfilled.
(2-3) Not applicable.
(4) No.
(5) Not applicable.
(6) The DEP was not advised that the occupier was going to backfill the dams and therefore did not attend the site. Given the low permeability clays underlying Lot 12 and the present leachate management system, the DEP considers that this is not an unacceptable situation.
