HERITAGE ACT — TIER 1 ACTIVITIES
644. Hon NEIL THOMSON to the Leader of the House representing the
Minister for Aboriginal Affairs:
I refer to the Aboriginal cultural
heritage code, which states that a tier 1 activity includes —
Removing litter from a waterway or
coastal waters in a way that does not involve disturbance to the bed or banks
of the waterway or coastal waters beyond that which was caused by leaving the
litter.
(1) Does this
mean that anyone removing litter from a waterway or coastal waters cannot do so
without a tier 2 permit if that litter is partially covered by sediment or
sand?
(2) If yes to (1), would a community group, such as
Keep Australia Beautiful WA, be able to apply for a single permit for
activities or would individuals have to seek individual permits?
(3) If yes to (2), has the minister consulted with all
community groups involved in removing litter from our community?

person is able to pick up litter off the ground without needing a permit. It is
open to organisations or individuals to apply for permits or management plans.
