refer to the Redlion Bus and Coach Company in Esperance, and ask: (a) does the Department of Transport (DOT) inspect and audit this company to ensure that it meets its occupational health and safety (OHS) obligations under the contracts that it
holds with the DOT; (b) if yes to (a): (i) who conducts the audits, including position title and role; (ii) according to the contract, how frequently are the audits conducted; (iii) what are the qualifications and/or experience held by the person conducting the audits; and (iv) please list the audits conducted over the past three years and who conducted them; (c) what is the relevant legislation, and any other
benchmarks stipulated by the DOT, used as the standard required of the
company for meeting its obligations under its contracts with the DOT; (d) is
it correct that the Transfer Safety Coordinator is the same person that has
conducted recent audits of this company on behalf of the DOT; (e) if no to (d), what is correct; (f) will
the Minister table the full text of the OHS Management System Audit Report Summary dated on or around 7
May 2014 including any and/or all non-compliance notices, non-action notices
and opportunities for improvement; (g) if no to (f), why not; (h) will
the Minister table the full text of the non-compliance report/non-action report action register dated on
or around 14 August 2014; (i) if no to (h), why not; (j) regarding the last audit conducted at this company in relation to OHS
compliance, were any non-compliances or non-actions or opportunities for
improvement still outstanding; (k) if yes to (j), what were the areas of non-compliance, non-action or opportunities for improvement, and how long was each
one outstanding for, stated in months and years; (l) from
the findings of the inspections and audits conducted by the DOT, has
this company always been in compliance with its obligations in relation to OHS
under its contracts with the DOT; (m) if no to (l), why not; (n) will
the Minister table a copy of all audit reports, including any and/or all non-compliance notices, non-action notices and opportunities for improvement for
the total duration of time since the company has held contracts with the
DOT; (o) if no to (n), why not; (p) is
the Minister and the DOT satisfied that this company has always been in compliance with its
obligations in relation to OHS under its contracts with the DOT; (q) if yes to (p), why; and (r) if no to (p), why not and what action will the Minister and DOT take to rectify the situation?

Insofar as the Public Transport Authority (PTA) is concerned, the PTA has a contract with Redlion Bus and Coach to operate intra-town school bus services. This question has been answered in that context.
(a)  Yes.
(b)(i)  The Public Transport Authority's (PTA) Transperth Safety and Quality Coordinator, Mr Kieran Kilgallon.
(ii)  Not stated in the contract however generally OSH Audits are performed on an annual basis.
(iii) Mr Kilgallon has a Diploma of Occupational Health and Safety and 10 years experience in this role.
(iv)  Mr Kilgallon conducted OSH Audits on 14 December 2011, 12 March 2013 and 7 May 2014.
(c)  The PTA recognises the OSH Act 1984 and OSH Regulations 1996.
(d)  No.
(e)  See the answer provided at part (b)(i).
(f) Yes.

(k)  Red lion's Internal Audit process and the Hazard Register were identified in the Audit which occurred on 14/12/2011 and the Hazardous Substance Risk Assessment was identified in the Audit of 12/03/2013. Although these matters remain partially complete, the PTA and Redlion Bus and Coach continue to work together to progressively resolve any outstanding matters on these issues.
(l)  No.
(m) Redlion Bus and Coach's Safety Management Plan has been audited against AS4801 - OSH Management Systems which was not stipulated in the original contract. Continued progress towards a compliant Safety Management Plan against this standard has been achieved.
(n)  Yes.
(o)  Not applicable
(p)  No, however it is not uncommon for the PTA Auditor to raise or identify areas of improvement during an audit with any company. Redlion Bus and Coach's Safety Management Plan has continued to evolve since the commencement of the PTA's audit process. The PTA has been working collaboratively with Redlion Bus and Coach management to improve the standard of the Safety Management Plan.
(q)  Not applicable
(r) All companies contracted to the PTA are obliged to meet their OSH responsibilities and regular inspections, audits and communication with the contractor are just some of the measures in place to assist the company to comply with the contract.
