I refer to the railway discontinuance legislation, which has been awaiting attention from Parliament for some years. In September 2001 the minister promised that she would ensure this legislation would be taken to Cabinet by February 2002. This Bill has not yet been presented to Parliament. (1) What is the reason for the continual delay of this legislation upon which members of the community are relying? (2) Will the minister make a commitment on when she will introduce this legislation to Parliament? Hon GRAHAM GIFFARD

I thank the member for some notice of this question. (1) The Government is committed to increasing the amount of freight that is carried by railways. Accordingly, prior to introducing discontinuance legislation for any sections of railway, the minister must be satisfied that there is no current or foreseeable requirement for the particular section of railway. The Director General of the Department for Planning and Infrastructure is examining the proposed closure of the Midland Junction-Welshpool and Fremantle-Kwinana sections of railway. The minister will consider his advice in due course. (2) Legislation to discontinue the Midland Junction-Welshpool and Fremantle-Kwinana sections of railway will be introduced to Parliament when the minister is satisfied that the closure of those sections of railway will not hinder the Government’s commitment to carry more freight by railways.
