476. Hon LJILJANNA RAVLICH to
the Minister for Education:
I refer to question without notice 192 asked in the
Legislative Council on 18 June 2013 regarding the 229 child protection
allegations being dealt with by the Department of Education in 2011–12,
and the minister's response that 229 misconduct matters that were
managed locally with central oversight were referred to the Corruption and
Crime Commission.
(1) When were
these 229 cases referred to the CCC and what has happened to these cases since
they were referred?
(2) Did the
education department notify parents of the children concerned of the referral
of the cases to the CCC; and, if not, why not?
(3) If yes to (2), by what means were parents notified?
(4) Has the
department received a report or reports from the CCC on any investigation
surrounding these 229 child protection allegations; and, if not, what has the
department done about it?

I thank the honourable member for some notice of this
question. This is valid as of 1 April 2014, when it was asked.
(1) Reports
are made to the Corruption and Crime Commission under section 28 of the
Corruption and Crime Commission Act 2003 as soon as an initial assessment is
made that the matter may be misconduct. Each case is then referred for local
management by the principal or site manager, with oversight by the standards
and integrity directorate.
(2) Formal
advice of referrals to the CCC is not routinely provided to parents at the time
the referral is made. However, during the course of any subsequent resolution,
principals often make reference to the fact that there is oversight of the
final outcome by the CCC.
(3) Discussions with parents can be in person, by telephone
or in writing.
(4) Pursuant
to sections 33(1)(c) and 37 of the Corruption and Crime Commission Act 2003,
the CCC referred each of these matters back to the department to address and
requested a report from the department under sections 40 or 41 of the CCC act.
