DEPARTMENT OF THE ATTORNEY GENERAL [see tabled paper no.___] The tabled paper contains details of ex-gratia payments made by the Department of the Attorney General, but excludes medical treatment liability matters agreed between the parties in settlement of civil claims, and one Equal Opportunity matter in the 2003/03 financial year in settlement of a claim. DEPARTMENT OF HEALTH The Department of Health records indicate that since February 2001 to date, there have been Act of Grace Payments made to five individuals; the details are as follows: ACT OF GRACE PAYMENTS: I) (1) Ms Debbie Freeman. (2) Two sums: $8,000 and $107,075.53. (3) On the 6 March 2004, whilst admitting a patient to the Swan Health Service mental health unit, Debbie Freeman, a community mental health nurse, was horrifically bashed by a patient awaiting examination, resulting in hospitalisation. The payment of $8000 was to cover transport and accommodation costs for Ms Freeman's sister and brother in law to visit Ms Freeman from Tasmania, both in July and October of 2004. The payment of $107,075.53, paid in October 2004, was to assist Ms Freeman in discharging her mortgage, which would significantly ease her current economic hardship that had resulted from the above incident. (4) The incident was widely reported and proper consultation undertaken prior to approval. The recommendation for this payment has been considered and supported by the Cabinet. Claim investigated, verified and checked in accordance with the process as per Treasurer's Instruction 319, prior to final processing. II) (1) Mr John Hosgood. (2) $255.50. (3) Spectacle Damage Claim. (4) Claim investigated, verified and checked in accordance with the process as per Treasurer's Instruction 319, prior to final processing in May 2001. An ex gratia payment was made to Mr Lee in respect of an extended period of inpatient stay in a private hospital subsequent to a decision by Mr Lee to complete the inpatient period of his care in a public hospital. At the time of Mr Lee's decision, no intensive care bed was immediately available to receive him. (4) Claim investigated, verified and checked in accordance with the process as per Treasurer's Instruction 319, prior to final processing when an Act of Grace payment was approved on the 10 January 2005. IV) (1) Ms Anne McKenzie. (2) $15,000. (3) Payment was originally initiated at the request of the Hospital Salaried Officer's Association on behalf of Ms McKenzie. The grievances also concern the management of Ms McKenzie's employment over the subsequent 18 months. (4) The allegations were investigated by an independent consultant and while it was not possible to fully substantiate Ms McKenzie's claims, there were serious concerns regarding the process used to move Ms McKenzie from her substantive position and the subsequent management of Ms McKenzie's deployment. DEPARTMENT OF HEALTH The Department of Health records indicate that since February 2001 to date, there have been Act of Grace Payments made to five individuals; the details are as follows: ACT OF GRACE PAYMENTS: I) (1) Ms Debbie Freeman. (2) Two sums: $8,000 and $107,075.53. (3) On the 6 March 2004, whilst admitting a patient to the Swan Health Service mental health unit, Debbie Freeman, a community mental health nurse, was horrifically bashed by a patient awaiting examination, resulting in hospitalisation. The payment of $8000 was to cover transport and accommodation costs for Ms Freeman's sister and brother in law to visit Ms Freeman from Tasmania, both in July and October of 2004. The payment of $107,075.53, paid in October 2004, was to assist Ms Freeman in discharging her mortgage, which would significantly ease her current economic hardship that had resulted from the above incident. (4) The incident was widely reported and proper consultation undertaken prior to approval. The recommendation for this payment has been considered and supported by the Cabinet. An ex gratia payment was made to Mr Lee in respect of an extended period of inpatient stay in a private hospital subsequent to a decision by Mr Lee to complete the inpatient period of his care in a public hospital. At the time of Mr Lee's decision, no intensive care bed was immediately available to receive him. (4) Claim investigated, verified and checked in accordance with the process as per Treasurer's Instruction 319, prior to final processing when an Act of Grace payment was approved on the 10 January 2005. IV) (1) Ms Anne McKenzie. (2) $15,000. (3) Payment was originally initiated at the request of the Hospital Salaried Officer's Association on behalf of Ms McKenzie. Payment was sought as a result of a complaint lodged by Ms McKenzie regarding her removal from her position at King Edward Memorial / Princess Margaret Hospitals in October 2000. The grievances also concern the management of Ms McKenzie's employment over the subsequent 18 months. (4) The allegations were investigated by an independent consultant and while it was not possible to fully substantiate Ms McKenzie's claims, there were serious concerns regarding the process used to move Ms McKenzie from her substantive position and the subsequent management of Ms McKenzie's deployment. Claim investigated, verified and checked in accordance with the process as per Treasurer's Instruction 319, prior to final processing when an Act of Grace payment was made to Ms McKenzie on the 23 August 2002.
