I refer to the Aboriginal Cultural Material Committee that gave conditional consent to Fortescue Metals Group for phases 1-4 and 7-9 of the rail corridor on 13 December 2006. Given that the Corruption and Crime Commission reported that John Bowler said, “So it is expected Sheila will overturn the ACMC decision” and that Julian Grill said, “So Carpenter just told you that Sheila should overturn that decision” and Bowler replied, “She will”, when, prior to December 2006, was the Fortescue Metals proposal discussed with the ACMC and what has been its position prior to December 2006? The ACMC was advised of phases 1-4 and 7-9 of the rail corridor at its meeting on 4 October 2006 when the ACMC considered a notice lodged by Fortescue Metals Group Ltd under section 18(2) of the Aboriginal Heritage Act 1972 for phases 5-6. On 3 November 2006 FMG lodged notices for phases 1-4 and 7-9. The ACMC considered these notices at its meeting on 6 December 2006. Papers were provided to members two weeks prior to the meeting. The ACMC did not discuss the notices, nor did it have a position on phases 1-4 or 7-9 prior to considering the notices at its meeting on 6 December 2006. At that meeting the ACMC resolved to recommend that the Minister for Indigenous Affairs grant conditional consent under section 18(3).
