GOLF COURSE — HARVEY
699. Hon BEN DAWKINS to the minister representing the
Minister for Planning:
I refer to the Shire of Harvey's
town planning scheme 12, clause 6.2, which states, according to my notes —
The Developer shall carry out the
development of the Golf Course � so that the Golf Course can function
effectively at least at the level of an 18-hole international standard Golf
Course �
The developer closed the golf
course in 2020 and it has now fallen into disrepair. The development and golf
course is now owned by Fiveight, an Andrew Forrest–affiliated company,
which can afford to pay for the obligations to which it is legally obliged to
provide.
(1) Will the minister exercise his powers under section
211 of the Planning and Development Act to refer the matter to the State
Administrative Tribunal for its independent report and recommendations on the
enforcement of the developer's obligations under town planning scheme 12
relating to the golf course?
(2) If no to (1), why not?
(3) Does the fact
that the WA Labor Party received a donation of $27 500 from Fortescue Metals
Group, a related entity to Fiveight, affect the decision to refer the matter to
the State Administrative Tribunal?

some notice of the question. The following response has been provided by the
Minister for Planning.
(1) No.
(2) The previous
Minister for Planning determined that the matter does not require referral to
the State Administrative Tribunal as conveyed to the member in writing in a letter
dated 26 October 2021.
(3) Questions
relating to donations to political parties are a matter for political parties.
