In relation to Lake Monger where there was no Section 18 application or consent to damage, alter, disturb and excavate a registered Aboriginal site by building a road and car park by the Town of Cambridge, I ask the Minister -

Subsequently, in 1999, the Town of Cambridge sought and received confirmation of the parameters of the original s.18 consent. In its letter to the then Minister for Aboriginal Affairs, the Town of Cambridge advised that it was seeking to develop a new access off Powis Street and to construct a 120 bay carpark on the grassed reserve between Dodd and Powis Streets. The letter also sought advice and comments about the impact of its proposed visitor facility between Powis and Dodd Streets and to advise about its intention to construct a new footpath link between Dodd and Powis Streets. In his reply the then Minister advised that, 'as the proposal to construct path access and a visitor facility between Dodd and Powis Streets is part of the Lake Monger Rehabilitation Plan, implementation is covered by the conditional consent granted in my letter of 18 July 1997….' As the then Minister's letter made no reference to the need for further s.18 approval for the works outlined in the letter, it has been accepted that no such further s.18 approval was needed. It is the Minister's understanding that the Town of Cambridge also proceeded on this basis.
