I refer to photographs taken on 21 January 2010, of clearing of vegetation and construction of bores undertaken with exploration equipment available for viewing at www.mp.wa.gov.au/rchapple/Kaltails, a document dated 3 December 2009 titled ‘KCGM Mining Proposal and Works Approval Application’, and question on notice No. 2005, 23 March 2010, and I ask -
(1) In relation to the answer for question on notice number 2005, part (1) can the Minister state on what date the investigation commenced, the methodology of how the investigation was undertaken and why it was not completed on the 20 April 2010?
(2) If no to (1), why not?
(3) Can the Minister state the specific date on which with the Department of Mines and Petroleum (DMP) Director of Environment provided written approval for the construction and clearing of vegetation for the monitoring bores depicted as proposed bores on page 44 of the document dated 3 December 2009?
(4) If no to (3), why not?
(5) If yes to (3), will the Minister table a copy of that written approval?
(6) Has KCGM employees/contractors breached any tenement conditions on General Purpose leases 26/165, 26/166, Prospecting Licence 26/2373, and other tenements in constructing monitoring bores and clearing vegetation in the immediate vicinity of these bores?
(7) If no to (4), why not?
(8) If yes to (4), will the DMP initiate forfeiture action and impose a high penalty on the tenement holders?
(9) Have the tenement holders or KCGM complied with all tenement conditions on G26/165, 26/166, G 26/143, G26/144, G26/99 – G 26/107, prospecting licences 26/2790 and 26/2373?
(10) If no to (10), -
(a) why not; and
(b) which conditions have not been complied with?
(11) Will the history of KCGM as an offender in breaching tenement conditions, be taken into consideration on imposing any penalty for any recent alleged breaches?

(1) The investigation commenced on 16 February 2010 and is still ongoing. The methodology involved is as per the Department of Mines and Petroleum's (DMP) standard investigation procedures and processes which include site inspections and review of Departmental records.

(3-4) The Kaltails Mining Proposal referred to is still under assessment and no approval has been given by the Director of Environment DMP.
