I refer to question on notice No. 528 of Thursday, March 21 2002 and the answers provided -
(1) Can the Minister state under what sections of the
Mining Act 1978
and Regulations the holder of the Mining tenement is accountable for compliance with obligations given that the excavation was carried out by Messrs Salkanovic and Mackie under a tribute agreement with the holder Goongarie Gold Pty Ltd?
(2) If not, why not?
(3) Can the Minister explain why the holder of the mining tenement, Goongarie Gold Pty Ltd, was held accountable for compliance with obligations by the Department given that the excavation was created by a bulldozer, carried out by Messrs Salkanovic and Mackie under a tribute agreement and was not the holder Goongarie Gold Pty Ltd?
(4) If not, why not?

(1) In relation to prospecting Licence 29/1338 the holder is responsible for compliance with the conditions of grant imposed under Sections 24, 40, 46 and 46A of the Mining Act 1978. Regulation 14 also applies. (2) Not applicable.
