NINGALOO MARINE PARK - COMPENSATION FOR AFFECTED FISHERMEN

Hon BRUCE DONALDSON : I refer to question without notice 988 asked on 31 October 2006 about compensation for commercial fishermen on the Ningaloo Marine Park extension. (1) Has the minister discussed this matter with the Treasurer and has the matter been progressed? (2) Considering that the Ningaloo extension was formally gazetted in September 2005 and that the Department of Fisheries received and acknowledged the initial application for compensation in October 2005, why has there been no resolution of this issue to date? (3) I understand that the imminent gazettal of the Muiron Islands marine management area will seriously impact on the livelihood of commercial fishermen based at Exmouth. As the marine management area is not covered by the Fishing and Related Industries Compensation (Marine Reserves) Act 1997, can the minister explain what methods of compensation or redress are available for the affected fishermen? (4) As the reserved area of the Muiron Islands is critical to the viability of the affected fishermen, what assurances can the minister give that there will not be an unacceptably long delay in implementing a compensation process, as is the case with the Ningaloo Marine Park, and that a satisfactory resolution can be reached quickly before the fishermen are forced out of business. I have approved the policy guidelines and operational framework that will guide the use of the Fishing and Related Industries Compensation (Marine Reserves) Act 1997. This involved discussions with the Department of Treasury and Finance. (2) Formal applications for compensation under the Fishing and Related Industries Compensation (Marine Reserves) Act 1997 can be submitted and dealt with only following the publication of a notice as required under section 6 of the act. This notice will be published on, or soon after, 22 August 2007. (3) It is my understanding that only one licence holder is affected whom I have met on two separate occasions. As with any request for redress in the fishery, I will review the options and make a considered judgement.
