(2) Acts Amendment (Land Administration) Act 1987 Part IX of this Act is yet to be proclaimed. It amends provisions within the Licensed Surveyors Act 1909 concerning the composition of the Land Surveyors Licensing Board and statutory functions of the Surveyor General. Part IX was not proclaimed pending a further review of the Licensed Surveyors Act and supporting regulations, and consideration of a new surveying act. Amendments were made to the Act in 1996 to address urgent outstanding matters. Recent advice from the Parliamentary Counsel’s Office is that Part IX cannot be proclaimed as it stands due to subsequent changes to the Licensed Surveyors Act . Carbon Rights Act 2003 The whole of this Act is yet to be proclaimed. Officers are researching the background to establish why this is the case and as soon as that information is to hand I will relay it to the Hon Member during the break. Road Traffic Amendment Act (No. 2) 1987 Section 11(b) of this Act is yet to be proclaimed. It amends section 89 of the Road Traffic Act 1974 to create a provision for compensation, obliging police officers to apply on behalf of victims to recoup damages from offenders who had unlawfully used and damaged a motor vehicle. The provision was not proclaimed because of Police concerns about being placed under a legal obligation to make an application for restitution on behalf of a person whose motor vehicle was unlawfully used and damaged. The offence created by section 89(1) of stealing a motor vehicle has since been repealed and an equivalent offence created in the Criminal Code . The amendment to section 89, which would be made by this section 11(b), is therefore obsolete. Road Traffic Amendment Act 1996 Section 8(3) of this Act is yet to be proclaimed. They will provide for the application of Annexes I and II of the Prevention of Pollution from Ships Convention to the operation of vessels to which the Western Australian Marine Act 1982 applies.
