I refer to a letter of complaint with supporting evidence dated August 14 2001 from Mr T Meyer-Forst which I understand was forwarded to the Minister for State Development -
(1) Will the Minister or the Department prosecute the holders/operator on Mining Lease 26/353 for breaching section 20(5) of the
Mining Act 1978
?
(2) If not, why not?
(3) Will the Minister ensure that all of the concerns and issues raised in the above letter are all thoroughly addressed in a reply to Mr Meyer-Forst?
(4) If not, why not?
(5) Has the owner/occupier of 30 Brownhill Road previously made complaints concerning a breach of section 20(5) of the
Mining Act 1978
?
(6) If so, can the Minister indicate when his office or the Department is going to prosecute the alleged offenders to highlight the fact that the practices are unacceptable?

(1) No. (2) All incidents referred to in Mr Meyer Forst's letter of 14 August 2001 have now been investigated and the Department of Mineral and Petroleum Resources is satisfied that in all cases there was either no breach of Section 20(5) of the Mining Act 1978 or, where a breach may have occurred, it was of a sufficiently minor nature as to not warrant prosecution. (3) Yes. (4) Not applicable. (5) Yes. (6) There are no current plans to commence any prosecutions.
