I refer to a proposal to construct commercial premises at 601 Wanneroo Road, Hamersley (DA14/2483) and I ask, given that the proposed development is on part of the land operated by Commonwealth Department of Communications, Broadcast Australia Pty Ltd or the ABC, does the Western Australian Environmental Protection Act 1986 apply fully to that site?

The development application, available through the Department of Planning website, states that the applicant is Broadcast Australia Pty Ltd. Following the privatisation and sale of the National Broadcast Network facilitated by the
National Transmission Network Sale Act 1998
(Cth), the land is no longer a "Commonwealth place". Therefore State laws, including the
Environmental Protection Act 1986
, will apply to the land provided that they are not inconsistent with a Commonwealth law (specifically the
National Transmission Network Sale Act 1998
).
Based on the information available, the Department of Environment Regulation considers that the
Environmental Protection Act 1986
applies to those parts of the site that are not used in connection with the provision of broadcasting services.
