I refer to the need for the Building and Construction Industry Training Council to close unless it is given sufficient funding. (1) Is the minister aware that his predecessor used section 9 of the Building and Construction Industry Training Fund and Levy Collection Act to resolve a similar funding crisis concerning the Housing Industry Association training foundation trust, as referred to in the 1996-97 BCITF annual report? I thank the member for some notice of this question. (1) The minister is aware of the directions referred to in the question. However, the directions given by previous ministers need to be distinguished from the current request in that they were given in the context of the operational plan of the Building and Construction Industry Training Board and related to matters that were within the powers of the board under the relevant Act. (2)-(3) The request by the Building and Construction Industry Training Council for the minister to provide a direction under section 9 of the Building and Construction Industry Training Fund and Levy Collection Act is made in relation to circumstances that are not similar to those referred to in (1). In this case, the funding requested is not in relation to the operational plan of the Building and Construction Industry Training Board. Therefore, the minister cannot give a direction under section 9 of the Building and Construction Industry Training Fund and Levy Collection Act The funding submissions of the Building and Construction Industry Training Board and the minister’s approval of that funding can only be made in that context.
