I refer to the Government's intention to sell 5.8 hectares of land to Crown for the purposes of a new hotel, and I ask:
(a) who provided the Government with the valuation of the land;
(b) was a written valuation provided to the Government, and if yes:
(i) did that valuation specifically take into account that that land needed to be remediated; and
(ii) if so, what was the estimated value of the cost to remediate the land;
(c) the Premier said in Parliament on 9 August 2012 that the valuation was provided from within Government. Which Government departments/agencies provided those valuations; and
(i) were they written valuations; and
(ii) on what date were the valuations provided to Government;
(d) specifically, what remediation is required on the land;
(e) did the Government obtain a written costing of the likely cost to remediate the land, and if so, who provided that costing and when;
(f) will the Government provide copies of any valuation of the land and the costings for its remediation;
(g) in Parliament on 9 August 2012, the Premier stated that Burswood still has an entitlement to acquire further land, and I ask:
(i) how much further land is Burswood entitled to acquire; and
(ii) have any approaches been made by Burswood to the Government to acquire this land, and if so, when were the approaches made and over which land were the approaches made;
(h) in Parliament on 9 August 2012 the Premier stated that Burswood has an entitlement to purchase an additional 10 hectares, and I ask:
(i) from what clause of the Casino (Burswood Island) Agreement Act 1985 does Burswood have an entitlement to acquire an additional 10 hectares of land;
(ii) on what date did Burswood officially notify the Government of their intent to exercise their entitlement to purchase an additional 5.8 hectares of land; and
(iii) in Burswood's notification of their intent to exercise its entitlement to purchase 5.8 hectares of land, did Burswood have estimations of the value of the land, and if so, what were those estimations;
(i) what consideration was given to the impact of the Premier's decision to facilitate Crown to place a hotel and associated car parking areas on land sold from the Burswood Golf Course to the residents located on the Peninsula estate immediately to the east and adjoining the proposed site;
(j) will those residents be afforded an opportunity to have any influence on the size, shape and specific positioning of structures and associated car parking areas on the land immediately to their west; and
(k) is there an intent to provide monetary compensation to those residents whose property values will be affected?

(ii) The valuation notes that the market value of $95,250,000 has not been discounted by the cost of identifying and remediating any contamination affecting the site or additional development costs associated with deep piling. These costs could be substantial and a figure of approximately $30 million was disclosed.

(d) This is a matter for the Burswood Entertainment Complex.
(e) This was based on information in the valuation and information in the procurement plan for the pre-construction site works for the stadium.
(f) No. The valuation report was included as part of the Cabinet Submission considered by Government, and as such it is a Cabinet in Confidence document.

(i) Under the
Casino (Burswood Island) Agreement Act 1985
Burswood can acquire up to 10 hectares of land from the site. So far, approximately 7.1 hectares have been acquired, leaving a balance of approximately 2.9 hectares.
(ii) No.
(h)
(i) Clause 6(5) Notwithstanding the provisions of the Public Works Act 1902, the Financial Administration and Audit Act 1985 or of any other Act the State may -
(a) on the recommendation of the Minister cause part or parts of any land excised from the Resort Site not exceeding in the aggregate 10 hectares to be granted or leased to the Trustee on terms and conditions approved by the Minister by notice published in the
Government Gazette
;
Clause 23(3) Without affecting the obligation of the Trustee under sub clause (1) (c) the State shall be at liberty to:
(aa) excise from the Resort Site any part or parts of the Resort Site agreed to be granted or leased to the Trustee under clause 6(5);
(a) excise from the Resort Site any part or parts thereof which may from time to time be reasonably required for public streets or for the purpose of providing services or facilities of like or similar kind to those referred to in clause 9 (4) or, with the agreement of the Trustee, for any other purpose, provided that the area or aggregate of the areas so excised shall not without the consent of the Trustee exceed -
(i) 10% of the area of the Resort Site as at January 1986; or
(ii) 10% of the aggregate of the area of (A) the Resort Site at the time of excision: and (B) any land which has been excised from the Resort Site pursuant to paragraph (aa)
whichever area is the greater;
(ii) 13 January 2012.
(iii) No.
(i) The residents on the Peninsula do not own the land acquired by the Burswood Entertainment Complex, further, as this was a commercial arrangement between the State and the Burswood Entertainment Complex it was important that the details remain confidential up until the time of the announcement.
(j) The Minister for Racing and Gaming has given a commitment that residents will be offered an opportunity to comment on the design aspects of the proposed hotel once Burswood has lodged the required development application with him.
