I refer to my previous questions (22 August 2006), concerning the Regional Resource Recovery Centre in Canning Vale, and further to the response provided by the Minister, I now ask -
(1) What conditions and commitments contained in Ministerial Statement No. 517 were apparently not complied with?
(2) Has the proponent responded by the deadline of 28 August to the DEC’s finding of possible non-compliance?
(3) If so, what (in summary), was the response?
(4) What action will the Government now take to resolve the odour problems affecting Leeming and Willetton residents, and when will this be done?

(1) Condition M1.1 (Implement the proposal as documented in Schedule 1 of the Ministerial Statement). Schedule 1 of the Ministerial Statement says the "in-vessel composting facility" will be located in an enclosed building that is maintained under negative pressure. DEC is of the view that the building is not currently maintained under negative pressure. Condition M2.1 (Implement the consolidated environmental management commitments). DEC is of the view that the proponent has failed to implement Commitment P15, as detailed below. Commitment P 15 (Implement the odour monitoring program). DEC considers that some aspects of the odour management plan have not been adequately implemented. In particular, DEC is of the view that the proponent is not conforming with the part of the management plan requiring that the "building shall be kept under negative pressure at all times". (2) Yes. (3) In summary, the Southern Metropolitan Regional Council has asserted that it has "always maintained a negative pressure within the Waste Composting Facility....". The SMRC has commented further that "it is recognised that improvements can be made in relation to odour management." (4) DEC is currently assessing the upgrade of the composting facility's biofilter system and the result this has had on the effect of odour. DEC will decide what action, if any, to take depending on the outcome of the assessment, by mid November 2006.
