representing the Attorney General:

refer to the Martin report of May 2019 on the Criminal Property Confiscation
Act 2000 and the Attorney General's statement reported on 5
December 2019 that the government will consider the recommendations made in the
report.
(1) Has the government implemented
any of the report's recommendations?
(2) If yes to (1), when?
(3) Are there any of the report's
recommendations that the government does not intend to implement?
(4) If yes to (3), which ones?
(5) Will the
Attorney General table the most recent briefing note or similar document he has
received on the government's implementation of the report's
recommendations?

I
thank the member for some notice of the question. I provide the following
response on behalf of the Attorney General.
(1)–(5) The
overarching recommendation of the Martin review was for the government to
consider repealing the Criminal Property
Confiscation Act 2000 and replacing it with a completely new act. There were
more than 60 other recommendations. The recommendations in the Martin review
remain under detailed consideration by the government, noting that the
criminal property confiscation scheme is complex and any reform, should it be
pursued, would be a large body of work. Cabinet is yet to consider the
recommendations of the Martin review.
