The wording of the Member's question is somewhat confusing because within the Western Australian subdivision system there is no 'appeal' right to the Western Australian Planning Commission. However, there are issues down at Serpentine-Jarrahdale that the Commission is assisting with.
Applicants have directly approached the Western Australian Planning Commission to assist with matters in the Shire of Serpentine-Jarrahdale relating to the creation of residential lots in the following circumstances:-
· where the Shire has failed to determine that local structure plans are satisfactory for advertising in accordance with the timeframe provided for in its town planning scheme;
· where no recommendation on subdivision applications has been forthcoming from the Shire and the application is nearing or has exceeded the 90 days in which the Commission should make a determination;
· where the Shire has not been prepared to provide written advice as to whether conditions of subdivision approval have been complied with and the Commission has been requested to endorse Deposited Plans;
· where the Shire has not been able to deal with engineering drawings in a timely manner.
The State Government has provided $250 000 to the Shire of Serpentine-Jarrahdale to assist the Shire come to terms more expeditiously with statutory planning issues.
