In addition to the specific legislative requirements relating to a night club licence, the Club Bayview is subject to the following further licence conditions:
Security requirements:
1. Crowd controllers, licensed under the Securities and Related Activities (Control) Act 1996), are to be employed at a ratio of two (2) crowd controllers for the first 100 patrons, and one crowd controller for each additional 100 patrons or part thereof, from 8 pm (or the time of opening the premises if after 8 pm).
2. Security personnel/Crowd Controllers (licensed under the Securities and Related Activities (Control) Act 1996), are to be present to monitor the licensed premises and the behaviour of patrons arriving and departing the premises from 8 pm (or the time of opening the premises if after 8 pm), until one (1) hour after trading ceases.
3. A video surveillance system must be in place and operational. The system must comply with the minimum requirements identified in the "Minimum Standards - Closed Circuit Television (CCTV) Security System" Policy or with requirements otherwise approved.
4. Images recorded via the video surveillance system must be retained for fourteen (14) days, and must be made available for viewing or removal by the Police or other persons authorised by the Director.
The licensee (Prow Pty Ltd) has advised that a compliant video surveillance system has been installed at these premises and is fully operational, and that the required security staff and crowd controllers are employed.
Numbers limitation:
Maximum accommodation numbers for the Avenue Bar will be 100 persons at any one time.
Maximum accommodation numbers for the Main Bar will be 305 persons at any one time.
Maximum accommodation numbers for the Verandah will be 100 persons at any one time.
Harm minimisation policy:
A House Management Policy, Code of Conduct and Management Plan have been developed in accordance with the Director of Liquor Licensing's Harm Minimisation Policy. These documents must be retained on the licensed premises and produced to any Authorized Officer if required. Additionally, the licensee shall ensure that the premises' House Management Policy and Code of Conduct are displayed in a prominent position on the licensed premises.
Inspections by the Department of Racing, Gaming and Liquor
DRGL officers conduct random audits and inspections of liquor licensed premises as part of a risk based compliance programme. In the last 12 months, DRGL officers have inspected Club Bayview 9 times.
Proceedings by the Department of Racing, Gaming and Liquor
Nil, with one Section 117 Noise/Behaviour Complaint lodged in May 2006 being resolved by way of conciliation in February 2008.
