I refer to the long-anticipated
repeal of the government's botched Aboriginal Cultural Heritage Act
2021, made possible with the passing of the Aboriginal Heritage Legislation
Amendment and Repeal Bill 2023, and note the Premier's comments that
the repeal bill will be proclaimed in mid-November.
(1) Since Western Australian landowners have already
waited 72 days since the Premier's first announcement of the
backflip, what is the rationale for further delaying the repeal?
(2) Can the
Premier confirm that the earliest opportunity to repeal the bill is 31 October,
being the date of the next Executive Council?

(1)–(2) I
believe that that is the appropriate date. I overheard some of the debate in
the upper house when one of the Nationals WA members asked about the
proclamation, so I believe that that is correct. It is appropriate that we do
this in a timely manner to make sure that all the necessary regulatory
arrangements are in place and that it is done in a manner that is efficient and
effective. The point about which an act is proclaimed and then progressed
really depends upon when the actual debate is completed in the Parliament. I note
that that bill was subject to extensive questioning, cross-examination and
debate in the upper house by the member's representatives in that
place, as is their right. Because the nature of that debate was dragged out,
the time lines are what they are in relation to the proclamation of the bill.
Therefore, if the member is concerned about the delay in this legislative process,
he should go ask his colleagues in the other place.
