I refer to the Albany Motorsports Park and the evidence that has been provided to Department of Water and Environmental Regulation (DWER) of multiple occasions of storm water from the Park washing unmanaged into the Marbelup Wetlands, directly from residents and through EnviroWatch, in breach of the conditions of approval, and I ask: (a) how many breaches of approval conditions has DWER recorded; (b) how many incidents of unmanaged stormwater run-off have been recorded; (c) has DWER conducted its own investigations into these breaches; (d) if yes to (c) can the Minister please table the report from each investigation; (e) has the City of Albany provided DWER with all water monitoring reports as required by the Local Water Management Strategy; and (f) if yes to (e) can the Minister please table copies of each report?

a) The City of Albany and the Department of Planning, Lands and Heritage are responsible for the Albany Motorsports Park's development application approvals and compliance with approvals conditions. DWER provides advice to the City of Albany on matters associated with the Local Water Management Strategy (a condition of the development application).
b) Between 23 June 2023 and 2 December 2025, DWER received 31 reports of alleged unmanaged stormwater discharge into lands to the south of the Albany Motorsports Park. The City of Albany is responsible for investigating incidents associated with the Albany Motorsports Park's development application approvals. DWER has engaged with the City regarding these alleged incidents.
c) - d) Not applicable
e) - f) The City of Albany submits the water quality reports to DWER for advice; however, this is not a regulatory requirement under legislation administered by DWER. These reports are associated with conditions of approval for the development application under the Planning and Development Act 2005. I am advised that the City of Albany will provide the reports in question should you request them.
