(1) Were there any findings by the Commission of improper or incorrect behaviour or procedure on behalf of any members of staff of the Education Department of Western Australia?

In the Reasons for Decision published on 9 March 2004, the Commission at first when determining the initial application, which was an application for the extension of time, to lodge an application, made no findings of improper or incorrect behaviour or procedure on behalf of any members of staff of the Education Department of Western Australia. That decision was in favour of the Department. Additionally, on appeal by Ms Stobie to the Full Bench of the Commission, in the Reasons for Decision published 21 September 2004, no findings of improper or incorrect behaviour or procedure on behalf of any members of staff of the Education Department of Western Australia were made. The appeal was subsequently dismissed.
