THE PILBARA INFRASTRUCTURE PTY LTD — PORT HEDLAND BERTHS
Given that, under the state agreement granting The Pilbara Infrastructure Pty Ltd berths at Port Hedland port, a port access regime is to be completed to protect the rights of the third parties seeking access to the TPI berths — (1) What action has the government taken in the past 13 months in relation to that regime? (2) Given the regime is designed to protect the interests of third parties, will the Premier table the document; and, if not, why not? Hon SIMON O’BRIEN

(1) An interdepartmental advisory committee was established by the previous government to conduct negotiations with The Pilbara Infrastructure Pty Ltd. Following lengthy negotiations and unsuccessful submissions to the previous minister responsible for the state agreement, TPI submitted an amended draft port access regime earlier this year, which was approved by the current Minister for State Development. (2) This question should be put to the Premier in his capacity as the Minister for State Development being the minister responsible for the relevant state agreement.
